Explanations of the plus one and plus two: the plus bid is used by bidders to break ties. In our auctions routinely we have several tie bids. Without a "plus bid" a tie is broken by the order of bids, that is which ever bid lands on the high bid (in-house, on-line or absentee) it will be the accepted bid. For example if an absentee bid is left for $500 and an in-house bid is received for $400 from a floor bidder, the absentee bid would hit at $450 and if the floor bidder would bid $500 they would win the lot even if an absentee bid of $500 was left first.

TERMS OF SALE

  


1.

Mound City Auctions LLC (Auctioneer) is hereby authorized to bid on the lots on this form up to the maximum price stated as a convenience for the bidder stipulated on this form and Auctioneer assumes no responsibility for failure to execute these bids or for errors relating to their exicution for any reason whatsoever.All property is sold AS IS WHERE IS. All pieces are sold as "attributed to" and Auctioneer makes no guarantees, warranties or representations, expressed or implied, with respect to the property of correctness of the catalog or advertisements or other descriptions of authenticity, authorship, physical condition, size, quality, rarity, importance, provenance, exhibitions, literature or historical relevance of the property of otherwise.  NO statement anywhere, whether oral or written, shall be deemed such a guarantee, warranty or representation.  Goods auctioned are often of some age.  Prospective bidders should inspect the property before bidding to determine condition, size, authenticity, degree of repair or restoration.  No refunds or credits shall be issued under any circumstances.

A premium of 18% of the successful bid price will be added thereto and is payable by purchaser as part of the total purchase price.

3.

All lots are sold subject to a 8.845% St. Louis sales tax unless a valid resale number is given.

4.

Payment must be made on day of purchase. Payment may be cash, certified check, wire transfer or credit card.

5.

Bidders are required to register prior to the sale and must furnish a valid driver's license in order to bid.  Bidders must use the number issued to them when they are the successful bidder. No transfer will be recognized from one buyer to another.

6.

In accordance with Missouri law, the highest bidder acknowledged by the auctioneer will be the purchaser. In the event of any dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder.

7.

Missouri law specifically stipulates specifically that on the fall of the auctioneer's hammer or call of "sold", title will pass to the highest bidder acknowledged by the auctioneer.  The highest; bidder is required to fulfill all the conditions set forth herein and the bidder assumes full risk on responsibility thereafter and is obligated to pay the full purchase price.

This is a final liquidation auction. All sales are final. No returns will be accepted under any circumstances.

9.

All items purchased at a Mound City Auction must be removed within 10 days after the date of the sale.  All items not picked up and removed from the premises within the 10 day period will be subject to storage charges of $10 per item per day and will be resold to pay for storage after 30 days.

10.

Form must be completly filled out for bids to be executed including signature. Auctioneer executes absentee bids as a convenience for clients and assumes no responsibility for falure to execute these bids or for errors relating to their execution for any reason whatsoever.If you submit a bid in an improper bid increment it will be rounded up. For example we will round a bid of $205.00 up to the proper increment of $225.00 or a bid of $965.00 will be rounded up to the proper bid increment of $1000.00. Increments are at the Auctioneers discretion and may not follow this example exactly: $50 - $200: $10 increment, $200 - $500: $25 increment, $500 to $1,000: $50 increment, $1,000 - $2,000: $100 increment, $2,000 - $5,000: $250 increment, $5,000 - $10,000: $500 increment, $10,000 - $20,000: $1000 increment, $20,000 - $50,000: $2,500 increment, $50,000 - $100,000: $5,000 increment, $100,000 - $500,000: $10,000 increment.
